[edit] NRCP regulatory announcement
In its role as the new National Regulator for Construction Products, the Office for Product Safety and Standards served prohibition notices on 23 December under the Construction Products Regulations 2013 (and the Northern Ireland equivalent) on Kingspan Insulation Ltd to prevent supply and require the recall of certain non-compliant K15 insulation board.
[edit] Kingspan insulation products
The prohibition notices apply to the following products, on the basis of supply at a lower level of performance than described:
- All Kooltherm K15 products manufactured between 1 August 2021 and 18 October 2021 covered by the Declaration of Performance dated 2 August 2021, Reference Number 1002.CPR.2013.K15.007
The prohibition notices apply to the following products, on the basis of supply without valid declaration of performance or appropriate conformity assessment procedure:
- All Kooltherm K15 products manufactured from 18 October 2021 covered by the Declaration of Performance dated 2 August 2021, Reference Number 1002.CPR.2013.K15.007
[edit] NRCP regulatory requirements
The notices require Kingspan to cease supply of affected product and to organise and implement the return of affected product from the market.
The company is required to contact any person supplied with affected product, those in the supply chain and final customers to arrange the return of all affected product, that has not been incorporated into buildings.
Notices requiring Kingspan to provide a detailed warnings relating to all affected product, including where it has been used in buildings, have been issued in draft form, as required by the Regulations, and will come into effect, subject to representations made by the company, in due course.
This is an ongoing enforcement action and is subject to the procedures set out in the relevant Regulations.
[edit] Response from the national house builders council (NHBC)
Following the announcement last month from the Office for Product Safety and Standards (OPSS) regarding Kingspan’s K15 product (including two prohibition notices issued by the OPSS in relation to K15) and the withdrawal by the British Board of Agrément (BBA) of its certificate for K15, this note explains to NHBC’s registered builder customers the impact on NHBC warranty and/or NHBC Building Control where these are being provided on their sites.
From 17 February 2022 onwards, we will be asking our registered builder customers for additional information regarding the use of K15 on all sites. If a builder customer has used K15 across a site or on any plot, we will require evidence confirming that the date of manufacture was on or before 31 July 2021 (for example, a copy of the invoice setting out the purchase date) or that the Declaration of Performance dated 2 August 2021 does not apply to the K15 used.
Because of the OPSS prohibition notice, we can no longer issue a building control final certificate or make an offer of warranty if K15 that was manufactured on or after 1 August 2021 and is subject to the Declaration of Performance dated 2 August 2021, has been used on site.
Our teams are working hard with our registered builder customers to ensure that this approach is implemented as smoothly as possible.
All sites that have not yet been finalled will have a condition placed on our system. Our Building Inspectors will work with our registered builders to obtain the evidence we need. Before the condition can be removed, we will either need evidence that Kooltherm K15 has not been used on the site at all or, if K15 has been used, we will need evidence that the product used was manufactured on or before 31 July 2021 or is not subject to the Declaration of Performance dated 2 August 2021.
